Stop Nuclear Verdicts Now

Robert Tyson & William Johnson
Managing Partners, Tyson & Mendes

This session will dive into the issues facing the healthcare industry in light of the COVID-19 health pandemic.   During the last decade, there have been numerous multi-million dollar verdicts and settlements in medical malpractice cases.  Now, due to compounding heightened expectations and exposures, medical malpractice lawsuits are on the rise.  This one-hour session will focus on how to apply important solutions using specific defense tactics to stop Nuclear Verdicts, including accepting responsibility, personalizing the medical defendant, always giving the jury a defense number, demonstrating empathy, and Tyson & Mendes’ unique and highly effective approach to arguing pain and suffering at trial.

Program Objectives:

  • The causes of Nuclear Verdicts in medical malpractice cases. Are there patterns common to these nuclear verdicts?
  • How to prevent Nuclear Verdicts.
  • How to combat COVID-19 claims and the impact of the pandemic upon future juries in medical malpractice trials.

About the Speakers:

Bob Tyson is the Managing Partner of Tyson & Mendes, a 150+ attorney national defense firm. Mr. Tyson is a trial lawyer who specializes in arguing damages in catastrophic injury, wrongful death, and high exposure jury trials. He is best known for his groundbreaking work on Howell v. Hamilton Meats, a case he argued and won before the California Supreme Court. Howell has since been hailed as the most significant insurance decision to come down in over 40 years – altering the way California interprets the collateral source rule and impacting the damages a plaintiff may recover.  Mr. Tyson helped save the insurance industry over $10 billion dollars every year. The victory earned Mr. Tyson the California Lawyer of the Year (CLAY) award from the California Bar Magazine, among other awards.

“Nuclear Verdicts: Defending Justice For All” is the Number 1 bestselling, first ever book written for the defense. In this groundbreaking book, Mr. Tyson sets forth the specific methods to beat plaintiff lawyers and achieve justice. It is the culmination of an over 30-year legal career, during which he has successfully resolved a variety of cases involving complex products liability, commercial and general civil litigation, professional malpractice, environmental and employment law – representing individuals, corporations, partnerships, professionals and many other different types of businesses.

Bill Johnson is the Managing Partner at Tyson & Mendes’ Nashville office. His practice focuses on defending against claims of medical malpractice, catastrophic personal injury, sexual torts, and employment practices liability.  Mr. Johnson has successfully represented skilled nursing facilities, assisted living facilities, physicians, hospitals, and many others throughout his twenty-four years of practice.
