Rule 8.3, which went into effect on August 1, 2023, requires a lawyer to report another lawyer if the reporting lawyer is aware of credible evidence that the other lawyer engaged in certain conduct that raises a substantial question as to that lawyer’s honesty, trustworthiness, or fitness as a lawyer in other respects. The behavior and circumstances that gives rise to Rule 8.3 reporting can be confusing. The consequences for failing to report, or inappropriately reporting, can be significant. This webinar will discuss the Rule, the guidance and case examples published by the California State Bar Office of Professional Competence, and seek to clarify these requirements in a practical and useful way.
Michelle Hackley is a licensed attorney and Registered Nurse with over 30 years’ experience in the healthcare sector. She currently serves as the Executive Director of The Foundation for Healthcare Quality, a non-profit organization providing compliance and risk management services to the healthcare community. As an attorney, Ms. Hackley advises and represents healthcare providers on a wide range of complex, multi-dimensional issues impacting long-term and day-to-day operations. Prior to her current role, she served as Associate Risk Management Counsel for Cedars-Sinai Medical Center where she continues to serve as an advisor on the Bioethics Committee.
Ms. Hackley obtained her Juris Doctor from The University of California, Berkeley, School of Law, her MBA with a concentration in Healthcare Administration from Texas A&M University, Corpus Christi, and her Bachelor of Science in Nursing from Grand Canyon University. She is a Certified Professional in Health Care Risk Management and a Fellow of the American Society for Health Care Risk Management. She is the V.P./President-Elect and Chair of the Education Committee of the Southern California Association for Healthcare Risk Management. She has lectured and written on a wide range of legal, compliance, and risk management topics impacting health care providers.
